The Authority for the Responsible Use of Cannabis (ARUC) is seeking energetic, flexible and open-minded individuals looking to join a team of dedicated employees to implement the cannabis legislative reform. Applications are being received for the following positions:
Senior Manager – Compliance and Enforcement
The selected applicant is expected to apply their background and knowledge in sciences and compliance to ensure that:
– cannabis produced by licensed associations is compliant with the stipulated quality parameters.
– The practices and procedures adopted by the associations are compliant with the directives issued by the Authority and mitigate the risks of quality failures.
– Inventory is thoroughly reconciled from seed to distribution, including generated waste.
– Adequate security measures are in place.
Enforcement of the above is expected to be carried out through inspections on-site at the cultivation and distribution sites of the associations, followed by court proceedings if necessary. Detailed job description as per below.

DUTIES AND RESPONSIBILITIES
• Manage the Compliance and Enforcement inspectors, providing tangible guidance and support.
• Implements a continuous improvement approach by seeking solutions that will allow the Unit to operate in an efficient and effective manner, inter alia, enhancing compliance amongst Cannabis Harm Reduction Associations.
• Proactively identifies potential areas of compliance vulnerability and risk and recommends and support remediation through corrective and preventive action plans.
• Establishes the goals and objectives of the inspectors, clearly communicating them with the team and ensures these are met within the predetermined timeframes and budgetary implications.
• Prepares, maintains, monitors, and evaluates sound Compliance and Enforcement Systems within the Authority in alignment with the current regulatory requirements.
• Prepares, issues, and periodically reviews the Authority’s standard operating procedures relating to compliance and enforcement to reflect best practices.
• Leads and/or participates actively in compliance and regulatory workgroups/conferences/seminars/conventions as directed by the Chief Officer (Compliance and Enforcement).
• Devises, implements, and monitors effectively Quality Assurance and Control mechanisms for the provision of non-medical cannabis by Associations as stipulated in the Authority’s Technical Standards and other binding instruments.
• Completes further training to enhance his/her professional knowledge, skills and aptitude related to the role.
• Coordinates the assessment of all the Associations’ operational policies and procedures to ensure compliance with the Technical Standards and other regulatory requirements.
• Coordinates the assessment of the implementation of the Associations’ operating activities to ensure they are in line with their policies and procedures that have been approved by the Authority.
• Conducts Cannabis Compliance Inspections/Investigations (including through on-site inspections) on Associations in accordance with the pre-established compliance plan.
• Responsible for the gathering, verifying, analysing, reviewing, and recording of information, documentation and other evidence relating to any compliance inspection/investigation.
• Ensures that non-conformances relating to any inspection, follow-up case, incident, inquiry, or member(s’) complaint(s) are investigated, evaluated, documented and risk assessed with governance and then followed up to ensure that the appropriate corrective action is undertaken sustained by accountability.
• Uses professional judgment in gathering inspection evidence and compile sufficient appropriate, and reliable inspection evidence when necessary.
• Draft investigative memoranda and other reports.
• Reports to Law Enforcement entities when there is non-compliance that may indicate fraud and/or unlawful acts and represents the Authority in administrative or court hearings on matters related to non-compliance with approved operational practices.
• Performs any other additional duties that may arise from time to time as directed by the Chief Officer (Compliance and Enforcement).

ELIGIBILITY CRITERIA
Eligibility to Work in Malta
Applicants must fall under one of the following categories to be eligible to apply for this post.
- Citizens of Malta.
- Citizens of Member States of the European Union who are entitled to equal treatment to Maltese citizens in matters of employment by virtue of EU legislation and treaty provisions dealing with the free movement of workers.
- Citizens of any other country who are entitled to equal treatment to Maltese citizens in matters related to employment by virtue of the application to that country of EU legislation and treaty provisions dealing with the free movement of workers.
- Any other persons who are entitled to equal treatment to Maltese citizens in matters related to employment in terms of the law or the law or the above-mentioned EU legislations and treaty provisions, on account of their family relationship with persons mentioned in paragraph (a), (b) or (c);
- Third country nationals who have been granted long-term residents status in Malta under regulation 4 of the ‘Status of Long-Term Residents (Third Country Nationals) Regulations, 2006’ or who have been granted a residence permit under regulation 18(3) thereof, together with family members of such third-country nationals who have been granted a residence permit under the ‘Family Reunification Regulations, 2007’.
- In possession of a residence document issued in terms of the ‘Residence Status of United Kingdom Nationals and their Family Members in Malta in accordance with the Agreement on the Withdrawal of the United Kingdom and Northern Ireland from the European Union and the European Atomic Energy Community Regulations’.

The advice of the Citizenship Unit within Community Malta Agency and the Expatriates Unit within Identità should be sought as necessary in the interpretation of the above provisions. The appointment of candidates referred to at (b), (c), (d) and (e)above would necessitate the issue of an employment licence in so far as this is required by the Immigration Act and subsidiary legislation. Working Languages
Applicants must be able to communicate fluently in the Maltese and English Languages.
Academic Qualifications
Applicants must be in possession of a qualification at MQF Level 7 (subject to a minimum of 60 ECTS/ECVET credits, or equivalent, with regard to programmes commencing as from October 2008) in relevant areas (science or enforcement) or a comparable professional qualification.
Or
A qualification at MQF Level 6 (subject to a minimum of 180 ECTS/ECVET credits, or equivalent, with regard to programmes commencing as from October 2003) in relevant areas (science or enforcement) or a comparable professional qualification AND two (2) years work experience in a relevant field (science or enforcement).
Or
A qualification at MQF Level 5 (subject to a minimum of 60 ECTS/ECVET credits, or equivalent, with regard to programmes commencing as from October 2003) in relevant areas (science or enforcement) or a comparable professional qualification AND four (4) years work experience in a relevant field (science or enforcement).
Or
A qualification at MQF Level 4 in relevant areas (Advanced Level or equivalent in a science subject) AND eight (8) years work experience in a relevant field (science or enforcement).
Moral Character
Applicants must have a good moral character and are expected to submit a recent (not more than one-month-old) police conduct certificate.
SALARY
The salary attached to the Post of Senior Manager (Compliance and Enforcement) shall commence at €31,681, rising to a maximum of €35,525. With the prior approval of the Executive Chairperson, the employee may also be eligible for the following allowances if they are directly related to his / her duties within the Authority:
- A communications allowance of €1,600 per annum,
- An expenses allowance of €1,000 per annum,
- A continuing professional development allowance of up to €700 per annum,
- A performance bonus of up to 15% on the gross basic wage.
TERMS AND CONDITIONS
- The selected candidate will be engaged on an indefinite contract.
- The appointment is subject to a probationary period of twelve (12) months.
